Personal Injury Lawsuit for Burn Injuries

There are many ways that a person can sustain a burn injury; if you believe you’ve been injured as a direct result of the negligence of a person, company or product manufacturer, you’ll want to speak with a personal injury attorney right away.

In our previous blog, we talked about product liability lawsuits, citing recent examples relating to people who were injured as a result of faulty e-cigarette batteries. In some cases, people sustained serious burns on their thighs and/or around their groin area after an e-cigarette battery spontaneously combusted while it was being stored in their pants pockets.

If the injured party decided to file a lawsuit against the product manufacturer, this would be an example of a personal injury lawsuit for a burn injury.

We’ll need to know more about how the accident happened

One of the most important things a jury will want to know relates to how and where the injury occurred. If you sustained a serious burn on your forearm and you have significant scarring, you may have a greater success of obtaining a substantial award than were you to have sustained a small burn that resulted in a temporary blister.

If you were injured at work and you were burned as a result of an accident, a jury may be less likely to award you a similar level of damages that they’d be willing to award should you have been injured because your employer failed to follow safety procedures.

There are many factors that will need to be taken into consideration when determining the value of your case. The best thing you can do is to be up front and honest with your attorney, as this will allow them to give you the best possible assessment if your case.

Compensation for pain and suffering

Depending on the extent of your injuries you may also be eligible to receive compensation for pain and suffering. If the defendant is found to be liable, they may be required to compensate you for both physical and emotional pain.
